Terms of Service

Please read these Terms of Service (“Terms”) carefully before using the CoachNotes application (the “App”). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the App.

  1. Acceptance of Terms: By using the App, you represent that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are under 13, you may not use the App.

  2. Use of the App: You may use the App only for lawful purposes and in accordance with these Terms. You agree not to use the App: In any way that violates any applicable federal, state, local, or international law or regulation.
    To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.
    To impersonate or attempt to impersonate JWelkin, a JWelkin employee, another user, or any other person or entity.
    To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the App, or which, as determined by us, may harm JWelkin or users of the App or expose them to liability.

  3. Intellectual Property: The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by JWelkin, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
    These Terms permit you to use the App for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App, except as follows: Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
    You may store files that are automatically cached by your Web browser for display enhancement purposes. You may print or download one copy of a reasonable number of pages of the App for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

  4. Termination: We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

  5. Disclaimer of Warranties: The App is provided on an “as is” and “as available” basis. JWelkin makes no representations or warranties of any kind, express or implied, as to the operation of the App or the information, content, materials, or products included on the App.

  6. Limitation of Liability: In no event shall JWelkin, its directors, officers, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App.

  7. Changes to Terms: We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them.

  8. Governing Law: These Terms shall be governed and construed in accordance with the laws of Michigan, without regard to its conflict of law provisions.
